1. Acceptance of Terms
By accessing or using the LipaGas website, mobile application, or energy services (the "Platform"), you agree to be bound by these Terms and Conditions and all applicable laws and regulations in the Republic of Kenya. If you do not agree with any of these terms, you are prohibited from using or accessing the Platform.
2. Eligibility and Account Registration
To use our Services, you must be at least 18 years of age. You agree to provide accurate, current, and complete information during the registration process and to keep your account details updated. You are responsible for maintaining the confidentiality of your account credentials.
3. Services Description
LipaGas provides clean energy solutions, including the sale and delivery of Liquefied Petroleum Gas (LPG), Smart Metering technology (PAYG), and energy management software (LipaGas OS). We reserve the right to modify or discontinue any part of the Services at any time without prior notice.
4. Orders, Pricing, and Payment
- Pricing: Prices for LPG and services are subject to change based on market conditions and regulatory adjustments by the Energy and Petroleum Regulatory Authority (EPRA).
- Payment: We accept payments via M-Pesa, Airtel Money, bank transfers, and credit/debit cards. Payment must be confirmed before delivery or service activation.
- Refunds: Refund requests are governed by our Refund Policy and will be evaluated on a case-by-case basis.
5. Delivery Terms
LipaGas aims to deliver LPG orders within the estimated timeframe provided at the time of order. However, delivery times are not guaranteed and may be affected by weather, traffic, or other unforeseen circumstances. You must provide a clear and safe delivery location.
6. Safety and Cylinder Ownership
LPG cylinders are high-pressure vessels and must be handled with extreme care. You agree to follow all safety instructions provided by LipaGas. Unless explicitly stated otherwise, LPG cylinders remain the property of LipaGas or its partner brands and are provided on a deposit/refill basis.
7. Prohibited Activities
You may not use the Platform for any illegal purpose, to solicit others to perform illegal acts, or to violate any international or local regulations. Unauthorized tampering with LipaGas Smart Meters or hardware is strictly prohibited and may result in legal action.
8. Intellectual Property
All content on the Platform, including text, graphics, logos, and software, is the property of LipaGas Energy Limited and is protected by Kenyan and international intellectual property laws.
9. Limitation of Liability
LipaGas shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our Services, including but not limited to loss of profits, data, or property damage, except as required by the laws of Kenya.
10. Indemnification
You agree to indemnify and hold LipaGas harmless from any claims, losses, or damages, including legal fees, resulting from your violation of these Terms or your use of the Services.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts in Nairobi, Kenya.
12. Changes to Terms
LipaGas reserves the right to revise these Terms and Conditions at any time. By continuing to use the Platform after changes are posted, you agree to be bound by the revised terms.
